Rental Policy

RENTAL AGREEMENT TERMS & CONDITIONS

1. GENERAL RESPONSIBILITIES
This Rental Agreement is made between J&J Equipment Rental (“J&J”) and the undersigned customer (“Customer”). The equipment specified herein is provided “as is” and in good working condition for the duration of the “Rental Period” and for the agreed rental subtotal price. The Customer agrees to return the Equipment prior to the expiration of the Rental Period or shall be subject to additional rental fees.

2. RESPONSIBILITY FOR EQUIPMENT
The Customer is fully responsible for the Equipment from the time it is rented out until it is returned. This includes, but is not limited to, maintaining proper oil levels and using the correct fuel type (diesel, if applicable). If the Equipment is lost, stolen, or damaged for any reason during the rental period—regardless of fault—the Customer is liable for all costs related to repair or replacement, including labor charges.

3. DESCRIPTION OF RENTAL PERIOD
The Rental Period begins on the date the Equipment is shipped from J&J and continues until it is returned to J&J’s yard or another location as advised in writing by J&J.

4. PHYSICAL CONDITION OF EQUIPMENT
The Customer acknowledges receipt of the Equipment in good working order, except for any defects noted in this Agreement. Equipment must be returned in the same working condition.

5. DAMAGE TO EQUIPMENT
The Customer shall assume and be responsible for the entire risk of loss or damage to the Equipment from any and every cause whatsoever. No loss or damage to the Equipment or any part thereof shall impair any obligation of the Customer under the Rental Agreement, which shall remain in full force and effect.
In the event of loss or damage of any kind to the Equipment, the Customer shall, at the option of J&J Equipment Rental:

  • Place the Equipment in good repair, condition, and working order; or
  • Replace the Equipment with like equipment in good repair, condition, and working order; or
  • If the Equipment is determined by J&J to be lost, stolen, destroyed, or damaged beyond repair, pay J&J the full replacement value.
    Cost-Sharing for Repairs: If repair costs are incurred while the Equipment is in the Customer’s possession, the Customer shall be responsible for the first $5,000 in repair costs. J&J Equipment Rental will cover the next $5,000. Any amount exceeding $10,000 shall be the responsibility of the Customer. This applies only to unintentional damage and excludes loss, theft, or gross negligence.

6. CARE AND MAINTENANCE
The Customer must care for and maintain the Equipment in good working condition at their own expense. Fuel is at the Customer’s cost. For long-term rentals, tire and/or track replacement is the Customer’s responsibility. J&J reserves the right to inspect and repair Equipment at any time, with repair costs added to the Customer’s invoice if due to negligence.

7. CUSTOMER LIABILITY
The Customer shall indemnify and hold harmless J&J from all claims, losses, penalties, legal fees, or damages related to injury or property damage caused during handling, transport, or use of the Equipment by the Customer or their representatives.

8. OPERATION OF EQUIPMENT
Only qualified operators may use the Equipment. The Customer agrees to return it in the same condition it was received, barring normal wear and tear.

9. EQUIPMENT TITLE
The Equipment remains the sole property of J&J. The Customer has no ownership rights. Immediate notice must be given to J&J if the Equipment is seized or subject to legal claim.

10. RETURN OF EQUIPMENT
The Customer shall make the Equipment accessible for pickup at the agreed time. Rental charges will continue until J&J is notified and the equipment is accessible. Additional charges apply for extra pickup trips. Equipment must be returned clean and unmarred; cleaning charges may apply otherwise.

11. DOWNTIME CONDITIONS AND CREDIT

No credit or allowance will be given for downtime unless the Equipment failure is reported in writing or the Equipment is returned immediately. If the Equipment becomes inoperable due to mechanical failure, and the failure is not caused by the Customer’s misuse, negligence, or failure to maintain the Equipment, the Customer will be entitled to a 50% credit on the daily rental rate for each full day the Equipment is down, starting from the time such failure is reported to J&J. A mechanic designated by J&J will need to diagnose the problem to determine whether the damage is due to mechanical failure or operator abuse/negligence. The credit will only be applied if the mechanic determines that the issue was caused by mechanical failure. This credit does not apply to weather-related delays or inaccessibility of the Equipment.

12. JOB LOCATION
The Equipment shall not be moved from the job site or reassigned without prior written consent from J&J.

13. INSURANCE REQUIREMENTS
The Customer must maintain insurance (property, liability, and fire) sufficient to cover full replacement value of the Equipment without depreciation. This coverage must be effective from shipment until return.

14. REFUELLING
The Customer must refuel the Equipment to the level recorded at delivery. If the Equipment is returned with less fuel, J&J Equipment Rental will refuel it and charge the Customer $3.00 per litre. This amount will be added to the final invoice.

15. RECEIPT OF EQUIPMENT
Receipt of Equipment confirms acceptance in good, safe, and serviceable condition. The Customer acknowledges the Equipment is suitable for its intended use.

16. PAYMENT TERMS
Payment is due upfront for short-term rentals, or weekly/monthly as agreed. Payment must be made by debit or credit card, or at J&J’s designated address. A 2% monthly interest (24% per annum) will apply to overdue accounts.

17. LIEN RIGHTS
J&J reserves the right to place a lien on any asset(s) or project site where the Equipment was used if payment is overdue.

18. WEATHER CONDITIONS
J&J Equipment Rental is not responsible for any delays, downtime, or lost productivity due to weather-related conditions, including but not limited to rain, snow, flooding, or extreme temperatures. No compensation, refund, or rental credit shall be issued for days when Equipment cannot be used due to inclement weather.

19. RENTAL EXTENSIONS
Any extension to the original Rental Period must be requested and approved prior to the expiration of the initial rental term. Extensions are subject to availability and must be paid in full before the extended period begins. If no extension is approved and payment is not received, J&J will arrange for pickup of the Equipment at the end of the original paid rental period, and charges will continue to accrue until return or collection.

20. BACKGROUND AND CREDIT CHECKS
J&J Equipment Rental reserves the right to conduct background and credit checks on all new customers prior to releasing Equipment. J&J may also conduct additional checks on existing customers when deemed necessary, including for overdue accounts or rental extensions. Refusal to comply may result in denial of service.
